Overview:
Here the Department of
Homeland Security (DHS Goes Again)! They have decided to update the I-9 Form
for 2022. We know that when updates happen Employers and Professionals scramble
to understand how the changes will impact the I-9 form process. At this time
(as previously done) DHS will have a public comment period sponsored by the
Federal Register. The deadline for this comment period is May 31, 2022.
Employers,
professionals, Employment law firms, employees and anyone who has an interest
in providing feedback can provide feedback.
Used by all employers,
Form I-9 has always had many traps for the unwary. DHS, with its proposed changes, is trying to
simplify and clarify things. There might be some effective changes like
reducing the number of pages in the instruction document and other changes that
should help the process.
The proposed changes
include:
Paper reduction:
· DHS is compressing
Sections 1 and 2 into one page instead of two.
· Section 3 will be a separate Reverification and Rehire Supplement that is a “stand alone” section, which only is accessed if needed for one of those purposes.
· The instructions which are attached to Form I-9 are reduced from 15 pages to 7, and users are directed to the online M-274 handbook and I-9 Central for all other questions.
Clarifications:
· The new I-9 places
more emphasis on what constitutes discrimination in the I-9 context.
· There will be clarified reverification and rehire instructions directly on the form.
· The onerous “N/A” requirement is eliminated by clarifying that fields that do not apply can be left blank.
There are other
changes that will require some getting used to when it comes to List C
Documents and details about the effective date of using the form when it has
been ready for use.
Session Highlight:
· Learn what the actual details are for making the changes to the I-9 form that expires on October 2022
· Learn what the changes are and when they are to be used
· Learn why many Employers and professionals were frustrated with the 15-page instruction page
· Learn what links will be helpful to Employers and professions to make the I-9 Form process efficient
· Learn how the I-9 Form Employer Manual, M274 is being promoted as an online manual
· Learn why the flexibility for remote option to be permanent is still being discussed. It is the hope of many that this option will be permanent but, what will that mean with the reverifying of document when DHS decides that Normal Operations Resume.
· Learn why having an internal audit will be in the company’s best interest
· Learn what other updates you will learn when this training is launched
Why Should You Attend:
Many advocates hoped
that the flexibility on “in-person” verifications might be continued beyond
COVID-19, but there is nothing about that flexibility on the new form. However,
problems that some users may have had due to software issues may be reduced
because DHS is removing electronic PDF enhancements. Employers and
professionals should attend the training to see what the updates are and what
other decisions are being made. This will help even internal audits that should
be conducted since DHS has indicated that they have increased I-9 Audits over
370%. Employers should take this opportunity to prepare for the new changes and
conduct their internal audit to reduce fines and penalties.
